Forensic engineer: 8th bullet likely hit Diaz
It look less than four seconds for 17 shots to be fired, including one that murdered Yolo County Sheriff's Deputy Tony Diaz on June 15, 2008.He was allegedly murdered by Marco Topete, 39, off County Road 5 in Dunnigan.
In testimony Thursday, forensic engineer Robert Cargill said of the 17 shots fired, Diaz was likely hit with the eighth shot about 1 1/2 seconds into the gunfire. The shooter was using an AR-15 semi-automatic rifle.
Diaz returned three rounds of gunfire. He died later that night at Woodland Memorial Hospital.
Cargill recreated the scene with Blake Graham, a firearms expert with the California Department of Justice, who fired the gun to determine the location of Diaz and the shooter.
Cargill said Diaz had been facing east or southeast, next to his patrol car, when the shots were first fired. This would have Diaz's back turned from the shooter.
Once he heard the gunshots, Cargill said Diaz got "small" and "lunged to the left in an attempt to evade the gunfire." Cargill added Diaz tried to get down to the ground when his upper left chest was hit.
From the angle Diaz was shot, Cargill said it would be "impossible for Diaz to be standing."
Cargill took the shell casings from the suspect's weapon to determine where the shooter was located. In the first reconstruction with forensics expert Craig Fries, the rifle was shown to be in the wall at the southwest corner of Jesse Gonzales' home.
Topete's Ford Taurus and Diaz's patrol car were at the southeast corner of Gonzales' property, on CR-5.
Cargill and others determined the ammunition used in this first reconstruction was different from what the shooter used. They got the correct ammunition and in a second reconstruction then had the shooter located just outside that corner.
A video reconstruction that Cargill and Fries created is scheduled to be shown at a future hearing, likely next week.
The court will not be in session on Monday or Tuesday.

Marco Topete is led by a Yolo County Sheriff's deputy into the court holding area to await transfer back to the Sacramento County Jail after the end of the court session Thursday afternoon.

This Monroe Detention Center is the main jail for Yolo County. The facility is the responsibility of the Sheriff’s Department Detention Division. The Detention Center is rated a medium/maximum security facility, allowing to provide housing for inmates of all security classifications. Most Yolo County arrestees will be brought to this detention center for booking, they will be held until bail is posted or until their arraignment.
Inmates are allowed two, 30-minute visitations each week. All visitors must be over 18 and have a valid photo ID. Visitors under the age of 18 must be an immediate family member of the inmate and must be accompanied by a parent or guardian.

Inmates are permitted two 30 minute visits per week (Monday through Sunday). All visitors must clear security measures (metal detector, etc). Only one car key may be taken with you during visiting (no key rings or car alarm remotes). Security of property will be the visitor’s responsibility. No property is to be left on the counters or be held by Sheriff’s personnel (NO EXCEPTIONS).
